Status of Adults

Here is the solution to an issue before it arises in the ATC!

The question was raised within the ACF as to whether their Adult
Instructors
(AIs) should be entitled to the minimum wage regulations - their AIs are
all
uniformed (e.g. Adult Sergeants, etc) and they don't have the equivalent
of
our CI.

The legal opinion given to the ACF is that:
  a.. AIs of the ACF are not 'employees' under a contract of service
within
  the meaning of the 1996 or 1998 Acts.
  b.. They are not 'workers' within the meaning of the National Minimum
  Wage 1998 Act.
  c.. They are therefore not entitled to receive the NMW.
This was given in a 19 page!
